The Fortville Farmers Market has a variety of passes to suit the various needs of vendors.
The Season Pass will allow the vendor to set up throughout the duration of the farmers market season. Its will also permit the vendor to join any other potential market opportunities (usually coinciding with a town event) free of charge.
The Monthly Pass will allow the vendor to set up a total of four times within a 6 week period. It is designed for more seasonal operations.
The Weekly Pass is designed for any vendor who is curious about joining the market and would like to test their product for a week.
The following are rules for vendors who wish to participate in the Fortville Farmers Market and serves as the criteria that must be agreed to upon submission of vendor application. The Leadership Team reserves the right to make exceptions to these rules at its discretion on an individual basis.
The primary purpose of the Fortville Farmers Market is to provide consumers an opportunity to purchase fresh, locally grown produce, meat, dairy, and other products from local producers.
The primary purpose of the Fortville Farmers Market is for the offering for sale articles for human consumption such as locally grown or produced fruits, vegetables, vegetable and bedding plants, nursery stock, edible grains, nuts, berries, aviary products, maple sugars, syrups or articles such as flowers grown and offered for sale by the growers or producers, members of his family or by his employees. Any produce purchased out of state, or not within immediate locality must be advertised as such. If any competing vendor has produce for sale that is local to central Indiana, no out of state produce will be approved. Local, handcrafted non-consumable goods will also be permitted, but not to exceed that of consumable goods. Final determination, including exemptions, will be determined by the Fortville Farmers Market Leadership Team.
Approved vendors will agree to offer only superior quality produce and goods at the Fortville Farmers Market in strict accordance with all applicable laws and Farmers Market policies. Upon request of the Market Leadership Team, each vendor will agree to provide the name and contact information of the farm or other source of the produce or other goods offered for sale.
The sale of eggs, cheese, meat, fish, poultry, or refrigerated dairy products is permitted.
Processed food items permitted for sale must follow the Guidance for Uniform Use of House Enrolled Act 1309 (copy available upon request). Products must be labeled in accordance with the Indiana Law and sold in pre-packaged form. The sale of these food items requires proper labeling and must consist of the following:
Final Determination of these issues is at the discretion Market Leadership Team and/ or the local health department.
Goods can be sold directly from vans, trucks (one ton or smaller) or cars. Vendors must furnish their own tables, chairs, or other display arrangements. In case of inclement weather, vendors must furnish their own protection. If tents or umbrellas are used, they are to be properly secured, as the vendor is responsible for any damage caused.
Vendors must post the price of their products.
Vendors must keep their produce in good condition. Low quality or dirty vegetables, fruit, etc. should not be displayed or sold.
Vendors will be expected to respect each other. It is expected that no vendor will speak negatively about other vendors, especially during market hours. No public disputes will be allowed. Please refrain from negative conversation. Vendors are expected to discuss any disputes confidentially with members of the Market Leadership Team. Vendors should not speak to any media sources without approval of the Market Leadership Team.
All vendor booths must have at least an 8 1⁄2 x 11 sign stating their farm or vendor name. Vendors may use other signage to promote the farm or booth as well
All items intended for human consumption must be kept at least 30 inches off the ground at all times, be under a tent or umbrella and be in safe and sound condition. Vendors are responsible for any damages resulting from sale of unsafe or unsound goods. No potentially hazardous foods should be sold. Permits for consumable goods must be visible at the Fortville Farmers Market
All items requiring immediate refrigeration must meet state, county, and local health requirements, rules, and regulations. Vendors are responsible for their own refrigeration source.
Vendors are responsible for complying with all applicable laws, regulations, and ordinances pertaining to their products. Scales and measuring devices must be legal and accurate.
Failure to completely clean-up assigned spaces and surrounding areas may result in loss of vendor privileges with no refund.
Vendors offering items for sale must reside in Central Indiana.
Any person who regularly and directly works in all stages of the cultivation, production, and harvesting of quality produce or other eligible goods may apply to become a market vendor. Prior to participating in the Fortville Farmers Market, all vendors must provide the Market Leadership Team with copies of all state and local permits and licenses required for the operation of their vending business and a copy of their certificate of liability.
The Market Leadership Team reserves the right to deny any vendor application or revoke vendor privileges of any person for failure to provide all requisite paperwork or to comply with all applicable laws and market policies, or on account of undesirable or suspect produce or goods offer for sale, spacer considerations, or for any other reason or cause as determined by the Market Leadership Team at its discretion. All vendors are subject to a premise visit to ensure integrity of products and labeling.
By participating in the Fortville Farmers Market, the vendor agrees not to institute any action or suit of law or inequity against the market, its employees, volunteers, agents, officers, and designees as a result of action taken under this contract. Vendors will not aid in the institution of prosecution or any claims for damages, costs, loss of service, expenses or compensation for or on account of any damages, loss or injury or property resulting from the terms of vendors’ participation in the market.
The vendor must agree to indemnify, hold harmless, release, waive, and forever discharge the Fortville Farmers Market employees, volunteers, agents, officer, and designees from all actions, damages, liabilities, and expenses, including reasonable attorney fees and court costs that may arise out of or as a result of the vendor participating in the market.
The vendor must provide a certificate of liability insurance for protection against damages in the event injury occurs at the market or an injury is caused by their products and will maintain insurance for the duration they participate in the market. The certificate of liability insurance must be on file with the Market Manager prior to booth assignment.
In the event that a vendor is found to be in violation of one or more of the above market rules the following process will be observed:

Verbal Warning and Inspection > violation is found, product excluded from market for the season > second violation occurs, expulsion of vendor from the market for the season with no refund a> Appeal to Market Leadership Team > Decision of the Market Leadership Team is final
The Fortville Farmers Market will not be affected by any kind of potential or inclement weather. Vendors must decide for themselves whether to participate on any given date.
